I am a mother who pays child support and both my children are out of school and are 18 years and older. i have a balance of $9,000 and now pay $400.00 per month to clear my debt. My question is will my State & Federal Tax returns continur to be garnished?

  1. i would ask your attorney about this as all state’s laws differ to some degree…

  4. Unfortunately, very likely, yes. I live in what I call The People’s Republic of Maryland, wherein I ran up some arrears and my Federal and State income tax refunds are STILL being garnished. My kids are 20 and 22, the elder one in jail, and I’m still paying, and even spent a Holiday weekend in jail, on arrears that should NEVER have accumulated. My child support payment was based on a $75,000 annual income. I lost my job through a corporate reorganization in October 2001, and due to the large number of layoffs that year by that particular company, I never did find work in my chosen field. I filed with the State of Maryland to have a review of my support obligation, which they granted, but not until May 2003. Between the time I lost my job in 2001 until the time of that hearing in 2003, they accumulated the arrears based on the $75,000 income I was earning. In other words, they refused to make the new payment retroactive. I was told by a Circuit Court judge that ‘there’s no provision in Maryland law to make the change retroactive”. So I’m still paying on $15,000 worth of arrears that I should never have been assessed. In my opinion, it’s state-sponsored extortion.

    Good luck.

  6. Yes, because you were behind in child support.Until the balance is paid or unless your ex lets you off the hook. After all it is deduable. Your kids might need the money to continue their education. Think about them. It’s time to stop being selfish. You-guys have a lot of years ahead. Mend fends while you can. I also know with money tight nowdays you are looking at the immediate. Think long range sometimes. It pays off. One can’t buy love. You did have them, not the other person that rised them. It balances out in the long run.

Experience with my brothers and sisters and their children being rised by the ex’s and them not paying child support and getting behind and it came to the same thing. My sister lost a son that was trying to find her after years of being in foster care and now she doesn’t even know where he is buried.

  7. Yes you will be garnished. However you can wait up to 3 years to file your taxes if the IRS owes you.

I just paid mine off this summer….whew!!
