  2. The person who prepares your taxes would know best. Based on what you said above, I would say yes since your provide her primary support. You may be able to file as head of household. Perhaps you should have some legal document drafted stating that you have the right to claim her. It is a good thing to state who claims the children in a divorce decree.

  3. This is a good question for a tax consultant. You need to have someone fill out your taxes. It costs a little bit,but it is better than paying a penalty.
