Can I still file a 2005 Minnesota tax return and collect the refund owed to me?

I didn’t file a MN return for 2005 because I didn’t pay state tax because I used to be considered a nonresident (Active Military). They changed the law in MN (my legal state of residence) and it appears I had a refund coming to me. Am I still able to file a 2005 state tax return this late and collect the refund? How long do you legally have to file if you don’t owe money or if you have a refund?

  3. if you didn’t file the return at all as you said, it would not be an amended form. it’d be considered a first filing. you are able to file up to 3 years ago and still receive any refunds. if you file after that time, your return will be considered out of statute and you will not qualify for a refund. below is the 2005 minnesota individual income tax form.

YES! You can go back three years. here are links for the 2005 instructions: http://www.taxes.state.mn.us/individ/prior_years/2005/instructions/m1_inst.pdf and the form M1: http://www.taxes.state.mn.us/individ/prior_years/2005/forms/m1.pdf . This year a new law was passed in MN to pay service members who have served in a combat zone any time from Sept 11, 2001 to now. Be sure to check and see if you qualify – See here: http://www.taxes.state.mn.us/individ/publications/M99inst.pdf and here: http://www.taxes.state.mn.us/individ/publications/m99fill-in.pdf
